Please read these Terms of Service ("Terms") carefully before using the ApneaStatic mobile application or web application (the "Service") operated by ApneaStatic ("we", "us", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part, you may not access the Service.

1. Acceptance of Terms

By downloading, installing, or using ApneaStatic, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Health and Safety Disclaimer

IMPORTANT: Please read this section carefully.

ApneaStatic is a training tool designed to assist with breath-hold training exercises. Freediving and apnea training involve inherent risks, including but not limited to loss of consciousness (blackout), hypoxia, and drowning.

• Never practice breath-holding in or near water without a trained safety buddy present.
• Never practice breath-hold exercises while driving, operating machinery, or in any situation where loss of consciousness could be dangerous.
• Consult a qualified medical professional before beginning any breath-hold training program, especially if you have any cardiovascular, respiratory, or neurological conditions.
• The app provides general training guidance only. It is not a substitute for professional freediving instruction or medical advice.
• Stop training immediately if you experience dizziness, tingling, headaches, chest pain, or any unusual symptoms.
• You use this app and follow its training programs entirely at your own risk.

We are not responsible for any injury, harm, or death that may result from the use of this application or the training practices it facilitates.

3. Description of Service

ApneaStatic provides:

• CO2 and O2 tolerance training tables with timer and voice guidance.
• Static apnea personal best tracking.
• Square breathing exercises.
• Training history and analytics.
• Optional cloud backup via Google Drive.
• Optional premium features via subscription.

4. User Accounts

4.1 Google Sign-In

You may optionally sign in using your Google account to enable cloud backup features. By signing in, you authorize us to access your basic profile information (name, email, profile picture) and Google Drive application data folder.

4.2 Account Responsibility

You are responsible for maintaining the security of your Google account and device. We are not liable for any loss or damage arising from your failure to protect your account credentials.

5. Premium Subscription

5.1 Premium Features

ApneaStatic offers optional premium features that may be accessed through a subscription purchase. Premium features include, but are not limited to: custom background music, playback speed control, and advanced settings.

5.2 Payment and Billing

Premium subscriptions are processed through the Google Play Store. Payment terms, renewal, and cancellation are governed by Google Play's terms of service. Subscription management, including cancellation, must be done through the Google Play Store.

5.3 Refunds

Refund requests are handled by the Google Play Store in accordance with their refund policies. We do not process refunds directly.

6. Free Version and Advertising

The free version of ApneaStatic displays advertisements powered by Google AdMob. These ads may be personalized based on your device information and usage data, subject to your consent where required by law. You can access an ad-free experience by subscribing to the premium version.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by ApneaStatic and are protected by international copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute the app or any part of it.
• Reverse engineer, decompile, or disassemble the app.
• Remove any copyright or proprietary notices.
• Use the app for any commercial purpose without our written consent.

8. User-Generated Content

You retain ownership of any custom training tables and data you create within the app. By using the cloud backup feature, you grant us permission to transmit your data to your Google Drive for storage purposes only.

9. Prohibited Uses

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to gain unauthorized access to the Service or its related systems.
• Interfere with or disrupt the Service.
• Use the Service to transmit malware or harmful code.
• Scrape, data mine, or extract data from the Service.

10. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

• The Service will function uninterrupted, securely, or error-free.
• The results obtained from using the Service will be accurate or reliable.
• The quality of any training programs, tables, or information obtained through the Service will meet your expectations.
• Any errors in the Service will be corrected.

11. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall ApneaStatic, its developers, affiliates, or partners be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Personal injury, physical harm, or death.
• Loss of data or training records.
• Loss of profits or revenue.
• Damage to your device.
• Any other intangible losses.

This applies whether the damages arise from use of the Service, inability to use the Service, unauthorized access to your data, or any other matter related to the Service.

12. Indemnification

You agree to defend, indemnify, and hold harmless ApneaStatic and its developers from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from: (a) your use of the Service, (b) your violation of these Terms, or (c) your violation of any third-party rights.

13. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease. You may terminate your use of the Service at any time by uninstalling the app.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Spain.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide notice prior to the new terms taking effect. Continued use of the Service after changes constitute acceptance of the revised Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
